“In the name of God Amen, I Asa Starkweather of the Town of Pompey, County of Ononadga, and State of New York ..?.. by devine providence and memory with a sound mind and memory though somewhat infeibled by lengthy illness. Do hereby make and declare this to be my last will and testament hereby revoking all former wills and testaments or codicels by me made written or published.
First reposing special trust & confidence in my trusty friend Elder Nathan Baker of the Town of Pompey aforesaid. It is my will and I do kindly make and appoint him my true and lawful executor.
Item first–It is my will and desire and I do hereby..?.. that one third part of all my estate both real and personal be given granted and let …?.. to my worthy and well beloved wife Adah for and during her natural life.
Item second–It is my further will that my present riding mare be also given to my beloved wife Adah over and above the one third part of my estae as bequeathed in item first.
Item third–It is my will and I do hereby give devise and bequeath unto my beloved children Clary, Ezner, Hilus, Adah, and Sophy all my estate both real and personal of every description in.?..all..?.in..?.in the following proportion or ratio to wit to each one of my Daughters, Clary, Adah & Sophy, one seventh part of all my estate to them and their heirs for ever. And to my sons
Ezner & Hilus two sevenths parts each one of them equally or remainder part of the estate to them and their heirs forever with this restriction that my Eldest Daughter Clary shall not be entitled to have any .?..or partition of any of my estate whatever until my son Ezner shall be twenty one years of age at which time she or her lawful heirs shall have a right and full power to ask..?.and..?.her..?.one seventh part of my estate as herein above …?
Item third–It is my further will that on the death of my beloved wife all the estae and property in Items first and second bequeathed to her went to my aforesaid two sons Hilus and Ezner in equal..?.. of half parts to each one of them or their lawful heirs forever. In testimony where of I have hereinto let my hand and seal this eighth day of December in the year of our Lord one thousand eight hundred and nine.
